Between ‘Us/We' Stay Norwich Apartments in partnership with Hospitality Norfolk and ‘you’ the guest

OUR SERVICED ACCOMMODATION TERMS OF BOOKING
These Terms are applicable to all Contracts of any kind made by Stay Norwich Apartments in partnership with Hospitality Norfolk ("the Serviced Accommodation provider") and its clients ("the Clients") and apply to all reservations, bookings and agreements for accommodation, dining and use of all the facilities at all of our managed, leased and/or owned properties.
Clients are invited to read these provisions and note their responsibilities, arrangements for payments, cancellation terms and limitations on the liability of Stay Norwich Apartments in partnership with Hospitality Norfolk. The Contract is conditional on the payment of the full booking amount being paid.

These Terms are governed by English law and apply to all Contracts of any kind made by Stay Norwich Apartments in partnership with Hospitality Norfolk except where we have agreed in writing other terms. By making this Contract, the Client is deemed to accept these Terms.

TERMS OF SUPPLY
(1) Interpretation
(1.1) In these Conditions:
"Us/We/Our/Ours" means Stay Norwich Apartments in partnership with Hospitality Norfolk.
"Arrival" means the date on which the Services are to be provided or shall start to be provided by the Us;
"Departure" means the date on which the Services terminate;
"Your Stay" means the time between Arrival and Departure;
"Client" means the person for whom Stay Norwich Apartments in partnership with Hospitality Norfolk has agreed to provide the Services in accordance with these Terms;

"Contract" means the contract for the provision of the Services, including these Terms as appropriate;
"Deposit" means damage deposit and the payment specified in clause 5 and Schedule, which is in addition to the full booking amount which is due to reserve your Apartment dates;

"Services" means the provision of accommodation services by the Us for the Client described in writing by the US and on its website or in its brochure;

"Schedule" means the Schedule of deposits, payments, and cancellation terms annexed to this Agreement in the form of a formal Invoice from Stay Norwich Apartments in partnership with Hospitality Norfolk.
"Standard Charges" means the charges shown in any brochure of Stay Norwich Apartments in partnership with Hospitality Norfolk or other published literature relating to the Services in force from time to time;
“Apartment” means any property under the ownership, lease, or management of Stay Norwich Apartments in partnership with Hospitality Norfolk and advertised by Stay Norwich Apartments in partnership with Hospitality Norfolk as serviced accommodation through either online travel agents, the Stay Norwich Apartments in partnership with Hospitality Norfolk websites, and/or by email/telephone call for accommodation that has not yet been listed.

"Terms" means these terms and conditions.
(1.2) The headings in the Terms are for convenience only and shall not affect their interpretation.
(2) Provisional Reservation and Confirmation of Reservations
(2.1) If We confirm the reservation, this Contract is conditional on the Client supplying credit or debit card details and the authority for charges to be deducted (including cancellation charges) on the payment terms outlined in the Schedule and Stay Norwich Apartments in partnership with Hospitality Norfolk full payment of a refundable deposit (if no damage or costs are incurred) from the Client on the payment terms outlined in the Schedule;

(2.2) If credit card details and payment authority is not given to Us by the Client, or if We have not received full payment of the refundable deposit from the Client as outlined in the Schedule, then we are subject to any outstanding obligation due to Us from the Client the Contract will cease to be of effect. The Services that are the subject of the provisional reservation will be released and resold without any further notification to the Client.

(2.3) You must be able to enter into a legally binding contract and be over 25yrs to enter into a Contract with the Us..
(3) Supply of the Services
(3.1) We shall provide the Services to the Client subject to the Contract. Reservations are only made with payment of the full amount due for the booking and the damage deposit

(3.2) The Client shall, at its own expense, supply Us with all necessary data or other information relating to the Services within sufficient time to enable Us to provide the Services in accordance with the Contract. The Client shall ensure the accuracy of all such information. Specific information requirements are contained in the Schedule. We may, at any time, without notifying the Client, make any changes to the Services which are necessary to comply with any applicable safety or other statutory requirements or which do not materially affect the nature or the quality of the Services.

(3.3) In the rare case that, due to unforeseen circumstances, We cannot deliver the Client-requested Services or accommodation, We shall offer equivalent or better Services or accommodation (which may be from a third party).

(4) Charges
(4.1) The charges payable by the Client shall be detailed in writing by Us. If no charges are specified or additional and varied Services are provided to the Client, the Client shall pay the Standard Charges at the prevailing rate on the day the Services are provided and any additional sums which are agreed between the Stay Norwich Apartments in partnership with Hospitality Norfolk and the Client for the provision of the Services.

(4.2) We may vary the Standard Charges from time to time.
(4.3) All charges quoted to the Client for the provision of the Services are inclusive of any Value Added Tax at the applicable rate unless otherwise stated.

(4.4) Standard Charges for accommodation are advertised on a per Apartment per night basis. Standard Charges for accommodation do not include other costs you may incur during Your stay (unless otherwise stated).
(4.5) Standard Charges and rates quoted are correct only for the specific number of guests, nights and dates at the time of enquiry. Should the Client change the number of guests, dates or room nights, then the Charges are subject to change.

(5) Deposit Payments
(5.1) Deposits are for protection against damage or costs incurred by Us because of the Client.
(5.2) The different requirements for Deposits are set out in the Schedule.
(6) Payment

(6.1) The payments to Us to be made by the Client (including Deposits) are to be made on the date(s) and in the amounts to be calculated as specified in the Schedule.
(6.2) If any services under the Contract are varied prior to arrival then the payment made will reflect the latest details contained in the written details of Stay Norwich Apartments in partnership with Hospitality Norfolk.
(6.3) Any additional charges due to Us from the Client for the Services shall be paid by the Client on presentation of an invoice.
(6.4) Advance Purchase Rates: If applicable. For Apartment reservations made using the advance purchase rate full payment will be taken at the time of booking. This payment is not refundable in the event of any amendment or cancellation. Advanced purchase rates will include a discount that deems the booking costs entirely non-refundable.

(7) Cancellation Charges ("NO SHOWS")
(7.1) The Client agrees to pay charges to Us in the event that the Client and/or their guests staying at Our Apartment cause any damage to the structure or interior fixtures, fittings and/or furnishings. Wear and tear excepted.
(7.2) We will provide a cancellation reference to a Client in the event of the Client making a cancellation and that number must be used in any future dealings with the Us. This number being the Invoice number that forms part of your contract.

(8) Variation in Services Required
(8.1) Any variation of numbers and/or accommodation requirements specified for the Services or other changes or additions must be agreed by the Client and the Us in writing.
(9) Liability of Stay Norwich Apartments in partnership with Hospitality Norfolk.

(9.1) When we the Services, which include any services supplied by a third party, We do not give any warranty, guarantee or other term as to their quality, fitness for purpose or otherwise, but shall, where possible, assign to the Client the benefit of any warranty, guarantee or indemnity given by the person supplying the services to Us.

(9.2) We shall have no liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any instructions supplied by the Client which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Client.

(9.3) Except in respect of death or personal injury caused by our negligence, or as expressly provided in the Terms, We shall not be liable to the Client by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of Us or otherwise), which arise out do or in connection with the provision of the Services (including any delay in providing or a failure to provide the Services) or their use by the Client, and the entire liability of Us in connection under or with the Contract shall not exceed the amount of Our charges for the provision of the Services, except as expressly provided in these Terms.

(10) Termination
We (without limiting any other remedy) at any time terminate the Contract by giving written notice (by letter or email) to the Client if the Client commits any breach of these Terms, or if the Client goes into liquidation, becomes bankrupt, makes a voluntary arrangement with its creditors or has a receiver or administrator appointed.

(11) Client Responsibilities
(11.1)Regular guests (people who have stayed with us at least once before) arrival and departure times for accommodation at any of our Apartments are from 4 p.m. via self-check-in and 10.00 a.m. via self-check-out, respectively. For new guests (who have not stayed with us before), we will arrange a “meet and greet” to ensure easy access to our properties. Clients should confirm their expected arrival time with Us prior to Arrival.

(11.2) The Client is responsible for the behaviour of his, her or its guests at our Apartments and, in particular, for the orderly conduct of guests attending to visit or otherwise making use of the Services. The Client must ensure that no unreasonable noise or nuisance is caused either for the Accommodation or its neighbours. The Client must comply with any reasonable request of Ours and with any policies of Ours as may apply to the Services from time to time.

(11.3) Smoking is prohibited in all interior areas of ALL our Apartments, including the bedrooms, dining room and lounge. Please use the designated cigarette bin outside for all cigarette stubs. Your deposit will be at risk if you fail to follow the no-smoking policy and leave any outside area with undisposed cigarettes.

(11.4) Security is provided to all our Apartments through a partner security firm as well as security camera systems and we will not hesitate to take action if we find that any of our Apartments are being used for illegal activities, business operations or any misuse outside of a residential living space. Parties, excessive noise and ill behaviour will not be tolerated, and Our security has instructions to call the police where it is appropriate and to remove anyone from the property, including their guests, for any breach of our terms as set out here. The clients’ booking/reservation will be terminated at this point, the damage deposit will be forfeited and no refund in full or part will be given.

Cancellation Charges
To Confirm booking at any time
Full payment is required to book your Apartment, along with the damage deposit. Only full payment will reserve your dates. Without payment, your booking is helped as provisional only.
FULL refund if cancelled no later than seven days before arrival date
Cancellation after check-in can be arranged with a Fourteen night's notice. All unused nights will be refunded (or kept as a credit balance for your next visit if you so wish) following the 14-night notice.
By arrival
Full payment for your entire stay must be made.
During your stay
Any additional services—extra linen/extra cleans — must be paid for before we can act on them. Please ask for details.
Booking damage deposits are refundable twenty-four hours after check-out.
On departure
If applicable, all outstanding charges must be settled.
If no damage has been made to the Apartment and no costs have been incurred from any other form of nuisance or issue, your deposit will be refunded to the card it was paid on within 24hrs
Accommodation Contracts:
For Services involving accommodation, the Client must supply full guest lists to the relevant contact of Stay Norwich Apartments in partnership with Hospitality Norfolk.
on the date(s) calculated by the Schedule. Failure to provide a guest list with full name and relation to the person or Company booking by this time will be deemed cancellation of the booking, and the cancellation charges detailed in the Contract will be applicable.

**All cancellation charges are subject to possible full reimbursement if accommodation is re-let and payment has been in accordance with the Contract. The amount reimbursed will be no more than the re-let amount charged of the original amount paid by the Client and only up to the original amount paid (by the night) by the Client.
